The Federal Mine Safety and Health Review Commission weighed in on MSHA’s suspended load standard with a decision that upheld an earlier finding by an ALJ. In the Sims Crane, Docket No. SE 2015-315-M decision, the commission held that walking under a spreader bar while not in the commission of attachment or detaching duties was in violation of 56.16009. Reference was also made to MSHA’s Feb. 2017 Program Policy Letter regarding that standard. The Aggregates Manager article outlining the decision can be read here.
